Huhaatee provides an online platform that allows users to create and sell their own T-shirts and merchandise.
We strictly prohibit users from designing or selling products that infringe on the intellectual property rights of others, including but not limited to copyright, trademark, and related rights.
If you believe that a user on Huhaatee has violated your intellectual property rights, please follow the steps outlined below.
A. Reporting Intellectual Property Infringement:
- Huhaatee will, in good faith, block access to or remove any content (“Content”) that appears to infringe on the intellectual property rights of third parties upon receiving a valid notice of infringement.
- Repeat infringers will have their accounts terminated. If you believe that Content on the Huhaatee platform infringes your copyright or other intellectual property rights, please send a notice of infringement with the following details to the Designated Agent:
- Identification of the infringed work: Provide details about the copyrighted work or other intellectual property, including registration numbers if applicable.
- Identification of the infringing Content: Include
- a description of how the material is infringing on the copyrighted work or other intellectual property;
- the location of the infringing material on the Huhaatee platform, with enough detail for verification.
- Contact Information: Provide your full name, mailing address, phone number, and email address.
- Statement under penalty of perjury: Declare that the use of the copyrighted work or intellectual property is unauthorized by the rights holder, its agents, or the law, and that the information provided is accurate.
- Signature: Include an electronic or physical signature of the person authorized to act on behalf of the rights holder.
B. Upon Receiving a Proper Infringement Notification:
- Huhaatee will remove or disable access to the allegedly infringing Content.
- The user whose Content was removed or disabled will be notified.
- Repeat offenders will have the infringing Content removed from the platform, and Huhaatee will terminate their access.
C. Procedure for Submitting a Counter-Notice:
If a notified user believes that the removed or disabled Content is not infringing or that they have the right to post and use it, they must submit a counter-notice with the following information to the Designated Agent:
- Identification of the removed or disabled Content: Include a description of where the material was located on the Huhaatee platform before it was removed.
- Statement under penalty of perjury: Assert that the removal or blocking of the Content was due to a mistake or misidentification.
- Contact Information: Provide your full name, mailing address, phone number, and email address.
- Jurisdiction Consent: Agree to the jurisdiction of the Federal Court for the judicial district where your address is located or, if outside the USA, where Goldteelic is located.
- Signature: Include your electronic or physical signature.
If a counter-notice is received, Huhaatee may send a copy to the original complainant, informing them that the removed Content may be restored or access to it may be reinstated within 10 to 14 business days unless the rights owner files a legal action.
Please note that under Section 512(f) of the DMCA, anyone who knowingly misrepresents that Content or activity is infringing may be liable for damages, including attorney’s fees.
